Patent illustrations
A properly drafted and correct Patent application is of great importance. The illustrations of your invention constitute an integral part of the Patent Application. In a patent application the first thing that an examiner usually looks up to is the illustration of your invention as an illustration gives the examiner a clear idea as to how is it that your invention would look like The examiner must be in a position to understand your invention from the illustrations clearly. The small details related to your invention must be clearly depicted in the invention or else the examiner will fail to notice the actual purpose of the invention.
A Patent specification must contain as many drawings whenever it is likely to illustrate the inventions with drawings. Patent illustrations are necessary when textual descriptions are not sufficient to explain the invention. Every feature of the invention has to be shown in detail through the drawing. This is applicable to objects of manufacture, processes and plants. Well developed drawings act as the foundation for determining the competency of a patent disclosure. However patent illustrations are not essential for inventions concerning a chemical compound or composition. The US Patent Rules stipulate the requirements regarding patent drawings. The size of the sheet on which the drawing has to be made, the type of paper, the margins, and many such hyper-technical details are provided in the rules. The purpose of laying down the standards is to print and publish the drawings in a uniform style when the patent issues, and to provide clarification to the persons using the patent descriptions.
Most patent applications have several sheets of drawings, with each sheet normally having multiple views of the invention. The various views (top, bottom, right, left, partial, exploded etc.) of the invention have to be shown separately 37 CFR § 1.84 lays down drawing requirements. The drawings can be in black ink or color. Only if the subject matter sought to be patented cannot be disclosed in a better way, color drawings, black and white photographs and color drawings are accepted by USPTO. Chemical or mathematical formulas, tables, computer program listings, and waveforms may be submitted as drawings and are subject to the same requirements as drawings. There are separate ways of showing moved position and modified forms of construction. Shading is allowed to indicate the surface or shape of spherical, cylindrical, and conical elements of an object.
Illustrations will be helpful in situations where something had been left out of the written disclosure by mistake. Any changes to be made in the drawing may require corresponding changes in the patent specification and additional expense to the inventor. Failure to make changes or to take corrective action to informal drawings within specified period will result in abandonment of the application. The scope of patent application can be broadened by filing it with multiple, detailed and professional drawings.
